                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            May 2, 2011      TO: Honorable Troy Fraser, Chair, Senate Committee on Natural Resources      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:SB1520 by Uresti (Relating to the consideration of applications for permits for certain commercial solid waste processing or treatment facilities.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would require the Texas Commission on Environmental Quality (TCEQ) to make a determination of competency of the applicant being able to safety operate a facility in compliance with all applicable laws before the TCEQ would issue, amend, extend, or renew a permit for a liquid waste processing or treatment facility. The TCEQ would be required to adopt standards for the making of competency determinations according to criteria prescribed in the bill. The bill would also allow the TCEQ to impose additional conditions on a permit to increase the likelihood of the safe operation of the facility by the applicant.         The bill would exempt local governments and persons who hold permits to dispose of hazardous, municipal, or industrial waste from the determination of competency requirements imposed by the bill.  Costs to the TCEQ in implementing the provisions of the bill are expected to be absorbed using existing agency resources.
