 A BILL TO BE ENTITLED
 AN ACT
 relating to the occupational licensing of spouses of members of the
 military.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  The heading to Chapter 55, Occupations Code, is
 amended to read as follows:
 CHAPTER 55. [RENEWAL OF] LICENSE WHILE ON MILITARY DUTY
 SECTION 2.  Chapter 55, Occupations Code, is amended by
 adding Section 55.004 to read as follows:
 Sec. 55.004.  ALTERNATIVE LICENSE PROCEDURE FOR MILITARY
 SPOUSE. (a)  A state agency that issues a license shall adopt rules
 for the issuance of a license to an applicant who is the spouse of a
 person serving on active duty as a member of the armed forces of the
 United States.
 (b)  Rules adopted under this section must include
 provisions to allow:
 (1)  alternative demonstrations of competency to meet
 the requirements for obtaining the license; and
 (2)  a period during which an otherwise qualified
 person may seek employment or practice with an expired license.
 (c)  The executive director of the Texas Department of
 Licensing and Regulation may issue a license by endorsement in the
 same manner as the Texas Commission of Licensing and Regulation
 under Section 51.404 to an applicant described by Subsection (a).
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
