                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            March 3, 2011      TO: Honorable Robert Duncan, Chair, Senate Committee on State Affairs      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:SB428 by Huffman (Relating to notice to a judgment debtor of the filing of a foreign judgment.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Civil Practice and Remedies Code relating to the authentication of foreign judgments. The bill would amend court procedures to make the judgment creditor, rather than the court clerk, responsible for mailing notice of the foreign judgment to the judgment debtor. To the extent the bill would result in less work and lower mailing costs for court clerks, the savings statewide is not anticipated to be significant. The bill would take immediate effect if it receives two-thirds the vote of members in both houses. Otherwise, the bill would take effect September 1, 2011. Local Government Impact No significant fiscal implication to units of local government is anticipated.
