                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            May 13, 2011      TO: Honorable Mike Hamilton, Chair, House Committee on Licensing & Administrative Procedures      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:SB438 by Nelson (Relating to the number of days a winery may sell wine under a winery festival permit.), Committee Report 2nd House, Substituted    No significant fiscal implication to the State is anticipated.  This bill would amend the Alcoholic Beverage Code, removing the limit on the number of days the holder of a winery festival permit could offer wine for sale within a 30 day period, and would increase the number of consecutive days (from three to four) that the holder of this permit could offer wine for sale at the same location. The Texas Alcoholic and Beverage Commission indicates that no fiscal implication is anticipated. Local Government Impact No fiscal implication to units of local government is anticipated.
