The bill would amend the Health and Safety Code to specify that the Texas Commission on Environmental Quality (TCEQ) may not prohibit or limit the idling of any motor vehicle with a gross vehicle weight rating greater than 8,500 pounds that is equipped with a heavy-duty diesel engine or liquefied or compressed natural gas engine that meets the model-year requirements and nitrogen oxide emissions standards specified by the bill. The bill would amend the Transportation Code to specify that the maximum allowable gross vehicle weight limit and axle weight limit for a vehicle or combination of vehicles equipped with an idle reduction system, as defined by the bill, is increased to an amount necessary to compensate for the weight of the idle reduction system. The bill would limit the weight increase to a maximum of 400 pounds. Based on the analysis of TCEQ and the Texas Department of Transportation, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within existing resources.
