This bill would amend Section 411.094 of the Government Code and authorize public institutions of higher education to obtain criminal history records for a student or applicant for enrollment who applies for on-campus housing. The information obtained may only be used by: (1) the chief of police of the institution; or (2) the housing office to evaluate current or prospective students who apply to reside in on-campus housing. Criminal history records cannot be released or disclosed to any person except the courts or with consent of the person. The records obtained must be destroyed by the institution as soon as practicable. Instituions of higher education are not expected to have a significant fiscal impact as result of this bill. Local Government Impact No fiscal implication to units of local government is anticipated.
