ANALYSIS S.B. 764 amends the Education Code to prohibit the board of trustees of an independent school district from imposing taxes, issuing bonds, using or authorizing the use of school district employees, using or authorizing the use of school district property, money, or other resources, or acquiring property for the design, construction, renovation, or operation of a hotel. The bill prohibits the board from entering into a lease, contract, or other agreement that obligates the board to engage in such a prohibited activity or obligates the use of district employees or resources in a prohibited manner. The bill defines "hotel" as a building in which members of the public obtain sleeping accommodations for consideration and specifies that the term includes a motel. EFFECTIVE DATE On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
