                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            May 6, 2011      TO: Honorable Pete Gallego, Chair, House Committee on Criminal Jurisprudence      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:SB879 by Whitmire (Relating to a local community supervision and corrections department monitoring certain conditions of bond and the administrative fees associated with certain department services.), As Engrossed    No significant fiscal implication to the State is anticipated.  The bill would add Article 17.441 to the Code of Criminal Procedure to permit a magistrate to designate a community supervision and corrections department (CSCD) to verify installation and monitoring of a breathalyzer ignition device. The magistrate may also require a defendant to pay a monthly administrative fee to the CSCD. The bill would also amend Government Code, Sections 76.015 (c) and 103.0211 to increase the upper limit on the administrative fee for CSCD programs from $40 to $60 per month. No fiscal impact to the state is anticipated.   Local Government Impact The Department of Criminal Justice and the Comptroller of Public Accounts report that a positive impact for local government is anticipated.    Brazos County CSCD reported an increase in administrative burden as well as a slight increase in revenue associated with the bill. The fiscal impact is not anticipated to be significant.   Bexar County CSCD reported a slight increase in revenue associated with the bill; however, the fiscal impact is not anticipated to be significant.
