The bill would give the Department of Agriculture (TDA) the authority to request documentation related to the delivery of motor fuel; authorize the Commissioner of Agriculture (Commissioner) to establish, by rule, documentation and reporting requirements related to motor fuel; authorize TDA to adopt rules necessary to bring about uniformity between the motor fuel standards established under the Agriculture Code and nationally recognized standards; authorize TDA to mark motor fuel dispensers that violate the Agriculture Code to be as Out of Order; and, would modify administrative penalty amounts for violations related to the regulation of motor fuels. Based on information provided by the Department of Agriculture, it is anticipated that any costs associated with the bill could be absorbed within the agencys existing resources. The bill would take effect September 1, 2011. Local Government Impact No fiscal implication to units of local government is anticipated.
