                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION            April 9, 2013      TO: Honorable Ryan Guillen, Chair, House Committee on Culture, Recreation & Tourism      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB1044 by Eiland (Relating to the operation of all-terrain vehicles and recreational off-highway vehicles; creating an offense.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Natural Resources Code, Parks and Wildlife Code, and the Transportation Code relating to the operation of all-terrain vehicles and recreational off-highway vehicles. The bill would authorize the state, county, or municipality to register an all-terrain or recreational vehicle that is owned by the state, county, or municipality and is operated on a public beach or highway in order to maintain public safety and welfare. The bill would allow the Department of Transportation (TxDOT), a county, or municipality to prohibit the operation of an all-terrain vehicle on a beach if TxDOT or the governing body determines that the prohibition is necessary for public safety.  Based on information provided by TxDOT, the Department of Motor Vehicles, and the Texas Parks and Wildlife Department, duties and responsibilities associated with implementing the provisions of the bill could be accomplished utilizing existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
