The bill would amend the Local Government Code to provide procedures for the administration of oaths and issuance of subpoenas in an arbitration proceeding involving firefighters or police officers in certain political subdivisions. The bill would create a misdemeanor offense if a person fails to appear as required by a subpoena. The offense would be punishable by a fine up to $1,000, confinement in county jail for not more than 30 days, or both. Local Government Impact Costs associated with enforcement, prosecution and confinement could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal implication. According to the Texas Municipal Police Association, no fiscal impact is anticipated.
