                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION            March 20, 2013      TO: Honorable Joe Deshotel, Chair, House Committee On Land & Resource Management      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB1477 by Callegari (Relating to a court order to disannex an area from a municipality.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Local Government Code to authorize a petition to be filed against a municipality that has failed or refused to disannex an area within 60 days of receipt of a petition. A district court could order a municipality to disannex an area if the municipality has not met certain obligations as defined by the provisions of the bill. Local Government Impact There could be a significant fiscal impact to a municipality that failed to comply with disannexation in a timely manner; however, the cost would vary depending on the number of cases filed, the value of land that resulted in a loss of ad valorem and sales tax revenue; and whether a municipality had an extraterritorial jurisdiction to annex.
