                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION            March 26, 2013      TO: Honorable Brandon Creighton, Chair, House Committee on Federalism & Fiscal Responsibility, Select      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB149 by Larson (Relating to the Texas Liberty Preservation Act; providing penalties.), As Introduced    No significant fiscal implication to the State is anticipated.   The bill would amend the Government Code to nullify certain sections of the federal National Defense Authorization Act of 2012 (NDAA). The bill would create a Class A misdemeanor penalty for individuals working in some capacity for the United States who attempt to enforce sections of the NDAA nullified by the bill. The bill would create a Class B misdemeanor penalty for individuals working in some capacity for the State of Texas who attempt to enforce sections of the NDAA nullified by the bill. The bill would require the Department of Public Safety to report to the Governor and Legislature any attempt by the federal government to implement sections of the NDAA nullified by the bill. It is assumed the costs associated with implementing the provisions of the bill could be absorbed within current appropriations. The bill would take effect immediately upon a two-thirds vote of all members in each chamber; otherwise, the bill would take effect September 1, 2013.
