A BILL TO BE ENTITLED
AN ACT
relating to the eligibility of persons with disabilities to use
certain public transportation services.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 461.009, Transportation Code, is amended
by adding Subsection (c) to read as follows:
(c) At the request of an individual who resides in a
provider's service area and is eligible to use the provider's
services, the provider shall provide written certification that the
individual is eligible to use the provider's services. Proof of
certification made under this subsection entitles the individual to
obtain services from any provider in the state for not more than 60
days during a 365-day period that begins with the individual's
first use of a provider's service outside of the service area in
which the individual resides.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2013.
