Smithee, Chair, House Committee on Insurance      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB1604 by Davis, Sarah (Relating to the creation of a standard request form for preauthorization of medical care or health care services.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Insurance Code relating to the creation of a standard request form for preauthorization of medical care or health care services.  The bill would require the Commissioner of Insurance to develop a standard form for requesting preauthorization of medical care or health care services by no later than January 1, 2014.  The bill would require the commissioner to appoint and consult with a committee about the technical, operational, and practical aspect of the form.  The bill would require that any preauthorization of medical care or health care services be considered granted if the health benefit plan issuer or the agent of the health benefit plan fails to timely respond to a completed form submitted by a requesting provider.  The bill would take effect September 1, 2013. Based on information provided by the Texas Department of Insurance, Department of State Health Services, Health and Human Services Commission, Texas A&M University System Administration, it is assumed that any costs associated with implementing the provisions of the bill could be absorbed within existing staff and resources. Based on information provided by University of Texas System Administration, the bill would have no fiscal impact. Local Government Impact No fiscal implication to units of local government is anticipated.
