                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION            April 5, 2013      TO: Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB1845 by Gooden (Relating to capital murder of a district attorney, criminal district attorney, or county attorney performing the duties of a district attorney.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Penal Code as it relates to the capital murder of a district attorney, criminal district attorney, or county attorney performing the duties of a district attorney. Under the provisions of the bill, the punishment of capital murder would be expanded to cover a person who murders another person in retaliation for performing the duties of a district attorney. The bill increases the penalty for certain offenses of murder. This penalty adjustment is expected to increase demands on state correctional resources by increasing the length of confinement in state correctional facilities. However, in the case of the bill, it is assumed that the number of offenders incarcerated under this statute would not significantly impact state correctional agencies' workload and programs.
