                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION            May 9, 2013      TO: Honorable Juan Hinojosa, Chair, Senate Committee on Intergovernmental Relations      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB1970 by Pickett (Relating to the authority of certain municipalities and counties to regulate subdivisions in the extraterritorial jurisdiction of a municipality by agreement.), As Engrossed    No fiscal implication to the State is anticipated.  The bill would amend Chapter 242 of the Local Government Code to provide requirements for certain municipalities and counties to regulate subdivisions within the extraterritorial jurisdiction of the municipality by agreement, and would establish exceptions for certain counties as defined by the provisions of the bill. A municipality could not regulate subdivisions or approve the filing of plats in an unincorporated area outside the extraterritorial jurisdiction except as provided by Chapter 791 of the Government Code. Local Government Impact There could be a fiscal impact to applicable municipalities and counties that chose to enter into an agreement that would vary depending on the number of agreements that are formed; however, the amounts are not anticipated to be significant. The bill would amend Chapter 242 of the Local Government Code to provide requirements for certain municipalities and counties to regulate subdivisions within the extraterritorial jurisdiction of the municipality by agreement, and would establish exceptions for certain counties as defined by the provisions of the bill.
