The bill would allow a magistrate to accept a sworn statement to support a search warrant provided by telephone or certain other means. The bill would require the magistrate or the magistrate's designee to fully document the sworn affidavit provided by telephone. The bill would allow a magistrate or magistrate's designee to electronically record and preserve any statement communicated under article 18.01(b), Code of Criminal Procedure. The Office of Court Administration does not anticipate any significant fiscal impact to the court system resulting from the bill.
