 A BILL TO BE ENTITLED
 AN ACT
 relating to the transfer of students of limited English proficiency
 from regular instructional programs to special education resource
 rooms.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter B, Chapter 29, Education Code, is
 amended by adding Section 29.0562 to read as follows:
 Sec. 29.0562.  TRANSFER OF STUDENTS TO SPECIAL EDUCATION
 RESOURCE ROOMS. A student who has been transferred out of a
 bilingual education or special language program to a regular
 all-English instructional program under Section 29.056(g) may not
 be transferred out of the regular all-English instructional program
 to a special education program resource room unless the student:
 (1)  while in the regular all-English instructional
 program, has been provided intensive bilingual education or special
 language program instruction, as appropriate for the student, for
 at least 18 school weeks; and
 (2)  has not progressed in reading, writing, speaking,
 or listening in English as determined using a test or assessment
 instrument described by Section 29.056(g).
 SECTION 2.  This Act applies beginning with the 2013-2014
 school year.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2013.
