                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION            April 4, 2013      TO: Honorable Joe Deshotel, Chair, House Committee on Land & Resource Management      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB3088 by Workman (Relating to liability of a political subdivision and potential penalties for a violation of certain laws relating to local permits.), As Introduced    No fiscal implication to the State is anticipated.  The bill would amend the Local Government Code to provide that a political subdivision would be liable for actual damages, consequential damages, and attorney's fees for a violation under Chapter 245. The Texas Education Agency (TEA) indicated the bill would have no direct fiscal implications for the Foundation School Program or the operations of the TEA. Local Government Impact There could be costs to a political subdivision for damages and attorney's fees for a violation; however, the amounts would vary depending on the number of violations and the amount of damages and attorney's fees.
