A BILL TO BE ENTITLED
AN ACT
relating to the degree to which power generation facilities consume
or adversely impact water in this state.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39.151, Utilities Code, is amended by
adding Subsection (d-2) to read as follows:
(d-2) The commission shall require an independent
organization certified under this section to consider
the extent to
which facilities used to generate electricity consume or adversely
impact water in this state. To the extent reasonably practical, the
independent organization shall base decisions relating to dispatch
of generation on the degree to which the facility consumes or
adversely impacts water in this state. The commission shall
require the independent organization to submit its findings and any
resulting actions in the report required under Subsection (d-1)(1).
SECTION 2. This Act takes effect September 1, 2013.
