The bill would amend Chapter 366 of the Transportation Code to require a tollway authority to exclude all mineral interests in and under property to be condemned without providing the owner of the mineral interests any ingress or egress rights to the surface of the property. Under current statute, Chapter 366 would apply only to the North Texas Tollway Authority. According to the Texas Department of Transportation, the provisions of the bill are not anticipated to have a fiscal impact on the department. Local Government Impact According to the North Texas Tollway Authority, no fiscal impact is anticipated.
