                    BILL ANALYSIS             H.B. 3504     By: Smith     Licensing & Administrative Procedures     Committee Report (Unamended)             BACKGROUND AND PURPOSE    Current law allows sweepstakes promotions to be conducted in Texas, but interested parties report that current law has been interpreted in such a way as to not allow sweepstakes prizes to be awarded on a retailer's premises. H.B. 3504 seeks to clarify the law and allow for sweepstakes prizes to be awarded to a customer on a retailer's premises.        RULEMAKING AUTHORITY    It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.       ANALYSIS    H.B. 3504 amends the Alcoholic Beverage Code to prohibit Texas Alcoholic Beverage Commission rules governing sweepstakes promotions from prohibiting a manufacturer or nonresident manufacturer from awarding a prize to a consumer on a retailer's premises in a sweepstakes.       EFFECTIVE DATE    September 1, 2013.
