The bill would amend Transportation Code to elevate the punishment for operating a commercial motor vehicle without a commercial driver's license from a Class C misdemeanor to a misdemeanor punishable by a fine not to exceed $1,000, or a Class B misdemeanor in the event that the offender had been convicted of the same offense within the previous year. A Class C misdemeanor is punishable by a fine of not more than $500. A Class B misdemeanor is punishable by a fine of not more than $2,000, confinement in jail for a term not to exceed 180 days, or both. Local Government Impact Costs associated with enforcement and prosecution could likely be absorbed within existing resources. Revenue from fines imposed and collected is not anticipated to have a significant fiscal impact.
