The bill would remove a provision that allows for computer manufacturers to offer a system for returning computer equipment as an option for meeting the convenience requirement established in Health and Safety Code, Section 361.955. In addition, the bill would add language that states that a collection system that allows for the return of computer equipment by mail alone does not meet the convenience requirements. The Texas Commission on Environmental Quality (TCEQ) reports that passage of the bill could lead to an increase in non-compliance for the recycling of computer equipment, especially among manufacturers having no physical presence in Texas and use the mail-back option as their primary means of collecting equipment for recycling. This could result in increased costs to the agency in pursuing enforcement actions. However, it is expected that any such additional costs would be absorbed using existing TCEQ resources.
