A BILL TO BE ENTITLED
AN ACT
relating to the construction of detention ponds by the Texas
Department of Transportation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter H, Chapter 201, Transportation Code,
is amended by adding Section 201.623 to read as follows:
Sec. 201.623. CONSTRUCTION OF DETENTION PONDS. In the
construction of detention ponds associated with its highway
projects, the department shall consider:
(1) using a permeable surface for the detention pond;
and
(2) completing the detention pond so that its finished
state would enable it to be used as green space, available for use
by wildlife or the general public.
SECTION 2. This Act takes effect September 1, 2013.
