                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION            April 16, 2013      TO: Honorable Richard Peña Raymond, Chair, House Committee on Human Services      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB447 by Dukes (Relating to the rights of a person apprehended without a warrant for emergency detention.), As Introduced    No fiscal implication to the State is anticipated.  The bill would amend the Health and Safety Code to require a peace officer who apprehends a person with mental illness for emergency detention without a warrant, to immediately notify the person of the reason for detention; and that the person will be informed of the person's rights within three hours after the person is initially transported to a facility. The bill would require the executive commissioner of the Health and Human Services Commission (HHSC) to prescribe the manner in which the person is informed of the rights. According to HHSC and the Department of State Health Services, no fiscal impact is anticipated. Local Government Impact No significant fiscal implication to units of local government is anticipated.
