BILL ANALYSIS H.B. 929 By: Aycock Judiciary & Civil Jurisprudence Committee Report (Unamended) BACKGROUND AND PURPOSE In recent sunset legislation concerning the Parks and Wildlife Department (TPWD), the legislature established its intent that the terms and purposes of the Parrie Haynes Trust be modified in order to transfer control of the trust to TPWD, among other purposes. Interested parties note that as the attorney general evaluated such modifications, several issues arose, including a determination that control of the trust could not be transferred to TPWD because the trust was established for the benefit of the orphans of Texas, a purpose which does not fall under TPWD jurisdiction. Accordingly, the trust has not been modified relating to the transfer of control. H.B. 929 seeks to resolve this situation by removing provisions relating to the requirement that such modifications be pursued. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS H.B. 929 repeals Section 17, Chapter 952 (H.B. 3391), Acts of the 81st Legislature, Regular Session, 2009, relating to the requirement for the Parks and Wildlife Department (TPWD) and the Texas Juvenile Justice Department to jointly seek representation by the attorney general to pursue a modification of the terms and purposes of the Parrie Haynes Trust so that, among other purposes, TPWD may be designated as the state agency responsible for the trust. EFFECTIVE DATE On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
