Kolkhorst, Chair, House Committee on Public Health      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB970 by Rodriguez, Eddie (Relating to regulation of cottage food products and cottage food production operations.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend Chapters 437, 211 and 231 of the Health and Safety Code, related to regulation of cottage food products and cottage food production operations. The Department of State Health Services (DSHS) indicates that any costs associated with implementing the bill can be absorbed within current operations. The bill would take effect immediately if it receives a vote of two-thirds of all members in each house; otherwise the bill would take effect September 1, 2013. Local Government Impact There could be a fiscal impact to a municipality or a county that would vary depending on whether a zoning ordinance that prohibits the use of a home for cottage food production operations is currently established.
