                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION            March 25, 2013      TO: Honorable John Carona, Chair, Senate Committee on Business & Commerce      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:SB1033 by Carona (Relating to the registration and use of marks, including trademarks and service marks.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Business and Commerce Code to prohibit a trade name from being registered as a trademark or service mark unless it is also a service mark or trademark, and to allow for the renewal of a mark during the 180 days preceding its expiration.  The Secretary of State indicates the provisions of the bill could be implemented within existing resources. The bill would take effect on September 1, 2013.
