The bill would amend the Business and Commerce Code to prohibit a trade name from being registered as a trademark or service mark unless it is also a service mark or trademark, and to allow for the renewal of a mark during the 180 days preceding its expiration. The Secretary of State indicates the provisions of the bill could be implemented within existing resources. The bill would take effect on September 1, 2013. Local Government Impact No fiscal implication to units of local government is anticipated.
