The bill would amend Chapter 303 of the Local Government Code to include the natural gas purchased by a corporation for resale to a local government under an interlocal cooperation contract is considered a public facility. Under current statute, a public facility means any real, personal, or mixed property, or an interest in property devoted or to be devoted to public use, and authorized to be financed, refinanced, or provided by sponsor obligations. Local Government Impact There could be a fiscal impact to a local government that formed an interlocal cooperation contract with a corporation to purchase natural gas; however, the amounts would vary depending on the terms of the contract; the price of the natural gas; and sponsor obligations.
