A BILL TO BE ENTITLED
AN ACT
relating to the inclusion of natural gas as a public facility for a
public facility corporation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 303, Local Government
Code, is amended by adding Section 303.007 to read as follows:
Sec. 303.007. NATURAL GAS AS PUBLIC FACILITY. Natural gas
purchased by a corporation for resale to a local government under an
interlocal cooperation contract described by Section 791.025,
Government Code, between the sponsor and the local government is
considered a public facility for the purposes of this chapter.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2013.
