The bill would amend the Family Code to resolve potential legal representation conflict of interest issues relating to protective orders. The bill specifies that subject to the Texas Disciplinary Rules of Professional Conduct, prosecuting attorneys in protective order cases are not precluded from previous, concurrent, or subsequent representation of a party in a protective order proceeding or representation of the Department of Family and Protective Services in another proceeding involving the party. The bill would take effect immediately if it received a vote of two-thirds of each house. Otherwise, the bill would take effect September 1, 2013. Local Government Impact No significant fiscal implication to units of local government is anticipated.
