       AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   S.B. 1460 is being proposed because of security and safety threats to the 105th District Court of Kleberg County.    Many court and attorney general opinions have referred to a bailiff as a necessary position for the function of the court in order to ensure the safety and integrity of the judicial process.    S.B. 1460 authorizes the judge of the 105th District Court to appoint a bailiff to serve the court in Kleberg County. By agreement, the commissioners of Kleberg and Kenedy Counties may allow the bailiff to serve in Kenedy County.   As proposed, S.B. 1460 amends current law relating to appointment of a bailiff to serve the 105th District Court.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.    SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 53.001, Government Code, by adding Subsection (k), as follows:   (k) Requires the judge of the 105th District Court to appoint a bailiff to serve the court in Kleberg County. Authorizes the bailiff to serve the court in Kenedy County by agreement of the commissioners courts of Kleberg and Kenedy Counties.   SECTION 2. Effective date: September 1, 2013.     

 

 

 

AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1460 is being proposed because of security and safety threats to the 105th District Court of Kleberg County. 

 

Many court and attorney general opinions have referred to a bailiff as a necessary position for the function of the court in order to ensure the safety and integrity of the judicial process. 

 

S.B. 1460 authorizes the judge of the 105th District Court to appoint a bailiff to serve the court in Kleberg County. By agreement, the commissioners of Kleberg and Kenedy Counties may allow the bailiff to serve in Kenedy County.

 

As proposed, S.B. 1460 amends current law relating to appointment of a bailiff to serve the 105th District Court.

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 53.001, Government Code, by adding Subsection (k), as follows:
