       AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   S.B. 1578 amends Section 814.103 (Service Retirement Benefits for Elected Class Service) of the Government Code to establish the calculation of a service retirement annuity for certain members of the elected class under Sections 812.002(a)(1) and (2) of the Government Code.   As proposed, S.B. 1578 amends current law relating to the calculation of a service retirement annuity for certain members of the elected class.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 814.103, Government Code, by amending Subsection (a) and adding Subsection (c), as follows:   (a) Provides that, except as provided by Subsections (b) (relating to prohibiting the standard service retirement annuity for service credited from exceeding 100 percent of the state salary being paid a district judge) and (c), rather than by Subsection (b), the elected class of membership for persons described by Section 812.002(a)(3) (relating to membership in the elected class of the retirement system being limited to district and criminal district attorneys to the extent that they receive salaries from the state general revenue fund), is an amount equal to the number of years of service credit in that class, times two percent of the state salary, excluding longevity pay payable under Section 659.0445 (Longevity Pay for State Judges and Justices), and as adjusted from time to time, being paid a district judge.   (c) Provides that the standard service retirement annuity for service credited in the elected class of membership for persons described by Sections 812.002(a)(1) (relating to membership in the elected class of the retirement system is limited to persons who hold state offices that are normally filled by statewide election and that are not included in certain Judicial Retirement System plans) and (2) (relating to membership in the elected class of the retirement system being limited to members of the legislature) is an amount equal to the number of years of service credit in that class, times two percent of the state salary, as that salary existed on August 31st, 2013, and excluding longevity pay payable under Section 659.0445, being paid a district judge.   SECTION 2. Makes application of Section 814.103(a), Government Code, as amended by this Act, prospective.   SECTION 3. Effective date: September 1, 2013.

As proposed, S.B. 1578 amends current law relating to the calculation of a service retirement annuity for certain members of the elected class.
