                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION            April 19, 2013      TO: Honorable John Whitmire, Chair, Senate Committee on Criminal Justice      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:SB1798 by Watson (Relating to the prosecution of the offense of obstruction or retaliation; providing penalties.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Penal Code as it relates to the prosecution of the offense of obstruction or retaliation. Under the provisions of the bill, a new offense would be created for people posting the residential address or telephone number of a public servant or a member of a public servant's family or household in retaliation for or on account of the service or status of the individual as a public servant. This offense would be punished as a third-degree felony or as a second-degree felony if the offense resulted in bodily injury. It is assumed that the number of offenders supervised or incarcerated under this statute would not significantly impact state correctional agencies' workload and programs.
