A BILL TO BE ENTITLED
AN ACT
relating to the evaluation by applicants for permits for certain
electric generating facilities of water-efficient cooling
technologies.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 382, Health and Safety
Code, is amended by adding Section 382.069 to read as follows:
Sec. 382.069. EVALUATION OF WATER-EFFICIENT COOLING
TECHNOLOGIES. The commission may not issue, amend, or renew a
permit for an electric generating facility in which water-cooling
technology is used or proposed for use unless the applicant has
submitted an evaluation of water-efficient cooling technologies,
including dry cooling, as an alternative to the water-cooling
technology used or proposed for use by the facility.
SECTION 2. The changes in law made by this Act apply only to
an application for a permit, permit amendment, or permit renewal
that is submitted to the Texas Commission on Environmental Quality
on or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2013.
