AUTHOR'S / SPONSOR'S STATEMENT OF INTENT Under current law, the only way for someone to request a formal opinion from the Office of the Attorney General (OAG) is to file that request through certified or registered mail, with return receipt requested. In OAG's experience, most requests for formal opinions are sent electronically (via e-mail) or through the regular U.S. mail. This bill would allow those individuals who are authorized by law to request a formal attorney general opinion to submit requests electronically. As proposed, S.B. 246 amends current law relating to the electronic submission of a request for an attorney general opinion. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 402.042(c), Government Code, to require that a request for an attorney general opinion be in writing and sent by certified or registered mail, with return receipt requested, addressed to the office of the attorney general in Austin, or electronically to an electronic mail address designated by the attorney general for the purpose of receiving requests for opinions under this section. SECTION 2. Effective date: September 1, 2013.
