The bill would amend the Code of Criminal Procedure to require a judge or a magistrate in whose court a criminal action is pending to discharge a surety's liability on a bond if certain conditions are met. A judge or magistrate that discharges a surety's liability and an indictment, information, or complaint is pending against the defendant would have the ability to issue a capias warrant or summons for the defendant to appear before the judge or magistrate.. Local Government Impact No significant fiscal implication to units of local government is anticipated.
