       AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   Under current law, municipalities are prohibited from adopting regulations regulating the ownership, transfer, possession, transport, licensing, regulation, of firearms, ammunition, or firearm supplies. They are further prohibited from regulating the discharge of a firearm at a sport shooting range.    S.B. 987 directs the attorney general to obtain an injunction against any municipality adopting regulations regulating the ownership, transfer, possession, transport, licensing, regulation, of firearms, ammunition, or firearm supplies or the discharge thereof of a firearm at a sport shooting range.    As proposed, S.B. 987 amends current law relating to requiring the attorney general to obtain an injunction against a municipality or county that adopts prohibited regulations regarding firearms, ammunition, or firearm supplies.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 229.001, Local Government Code, by adding Subsection (f), to require the attorney general to bring an action in the name of the state to obtain a temporary or permanent injunction against a municipality adopting a regulation in violation of this section.    SECTION 2. Amends Section 236.002, Local Government Code, as follows:   Sec. 236.002. FIREARMS; SPORT SHOOTING RANGE. (a) Creates this subsection from existing text. Makes no further changes to this subsection.   (b) Requires the attorney general to bring action in the name of the state to obtain a temporary or permanent injunction against a county adopting a regulation, other than a regulation under Section 236.003 (Regulation of Outdoor Sport Shooting Range), in violation of this section.   SECTION 3. Effective date: upon passage or September 1, 2013. 

 

 

 

AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

S.B. 987 directs the attorney general to obtain an injunction against any municipality adopting regulations regulating the ownership, transfer, possession, transport, licensing, regulation, of firearms, ammunition, or firearm supplies or the discharge thereof of a firearm at a sport shooting range. 

 

As proposed, S.B. 987 amends current law relating to requiring the attorney general to obtain an injunction against a municipality or county that adopts prohibited regulations regarding firearms, ammunition, or firearm supplies.

 

RULEMAKING AUTHORITY

SECTION BY SECTION ANALYSIS
