83S20156 JSC-D By: Canales H.B. No. 32 A BILL TO BE ENTITLED AN ACT relating to an interim study on the Evins Regional Juvenile Center in Edinburg. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. (a) The executive director of the Texas Juvenile Justice Department shall create a committee composed of employees of the department to conduct an interim study on the conditions at and operation of the Evins Regional Juvenile Center in Edinburg. (b) The committee shall prepare a report that includes: (1) a summary of the incidents of violence, abuse, neglect, exploitation, or other misconduct or criminal activity occurring or alleged to have occurred at the facility in the preceding 10 years; (2) the response of the facility to the incidents or allegations of violence, abuse, neglect, exploitation, or other misconduct or criminal activity, including steps taken by the facility to: (A) implement the remedial measures prescribed by the Civil Rights Division of the United States Department of Justice in March 2007; (B) investigate the events leading to the arrest of officers in June 2013 and, as necessary, implement measures to prevent future similar incidents; and (C) enforce other facility and Texas Juvenile Justice Department policies to prevent and address violence, abuse, neglect, exploitation, or other misconduct or criminal activity in the facility; and (3) recommendations for improving conditions at the facility. (c) The committee shall submit the report under this section to the governor, lieutenant governor, speaker of the house of representatives, and appropriate standing committees of the legislature not later than December 1, 2014. SECTION 2. This Act expires June 1, 2015. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect on the 91st day after the last day of the legislative session.
