                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 83rd LEGISLATURE 2nd CALLED SESSION - 2013            July 12, 2013      TO: Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB49 by Dutton (Relating to a requirement that a peace officer obtain a search warrant before conducting a body cavity search.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Code of Criminal Procedure to require law enforcement to obtain a search warrant before conducting a body cavity search. Magistrates issue search warrants; however, any increased time spent considering the applications for search warrants is expected to be minimal. The Office of Court Administration indicated no significant fiscal impact is anticipated. The Department of Public Safety indicated no fiscal impact is anticipated. Local Government Impact No significant fiscal implication to units of local government is anticipated.
