                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            March 14, 2015      TO: Honorable Geanie Morrison, Chair, House Committee on Environmental Regulation      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB1284 by Simmons (Relating to the review by certain governmental entities of a permit application for a solid waste facility.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would require the Texas Commission on Environmental Quality (TCEQ) to mail a copy of a solid waste permit application or a summary to each municipality in whose extraterritorial jurisdiction (ETJ) the solid waste facility is located, and in addition, to each municipality with a boundary located not more than one mile from the facility. The bill would also require the TCEQ to consider comments and recommendations submitted by these municipalities, and it authorizes the TCEQ to deny or amend the application based on their comments. Based on information provided by TCEQ, duties and responsibilities associated with implementing the provisions of the bill could be absorbed using existing resources.  Local Government Impact No significant fiscal implication to units of local government is anticipated.
