Smithee, Chair, House Committee on Judiciary & Civil Jurisprudence      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB1406 by Sheets (Relating to the liability of a political subdivision of this state for certain claims relating to land acquired by the political subdivision under certain circumstances.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Civil Practice and Remedies Code regarding the liability of a political subdivision for tort claims relating to land acquired under certain circumstances. Current law provides for liability under certain circumstances for municipalities acquiring land at a sale following foreclosure of a lien held by the municipality. The bill would expand this provision to include property held by any political subdivision, including land acquired through a lien foreclosure and land conveyed to the political subdivision by the owner of the property in payment of taxes. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources Local Government Impact No significant fiscal implication to units of local government is anticipated.
