                    BILL ANALYSIS             H.B. 1415     By: Kuempel     Urban Affairs     Committee Report (Unamended)             BACKGROUND AND PURPOSE    Recent legislation amended the law relating to cemeteries in certain municipalities in order to address the desire of such municipalities to establish a cemetery, other than a family cemetery, within the boundaries of those municipalities. Interested parties note that an expired deadline now exists in the law, and H.B. 1415 seeks to address this issue.       CRIMINAL JUSTICE IMPACT   It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.       RULEMAKING AUTHORITY    It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.       ANALYSIS    H.B. 1415 redesignates and amends a Health and Safety Code provision to remove the expired deadline by which a person must have filed a written application to establish or use a cemetery located inside the boundaries of a municipality with the governing body of a municipality that is located in three or more counties, has a population of 18,000 or more, and does not have a cemetery within its boundaries, other than a family cemetery. The bill retains the authorization for a person to file such an application.       EFFECTIVE DATE    On passage, or, if the bill does not receive the necessary vote, September 1, 2015.
