A BILL TO BE ENTITLED
AN ACT
relating to providing notification to certain legislators and
county judges of certain applications or notices for an electric
railway project.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 199, Transportation Code, is amended by
adding Section 199.003 to read as follows:
Sec. 199.003. NOTICE OF ELECTRIC RAILWAY PROJECT. If the
department is notified of an application submitted to the federal
Surface Transportation Board for an electric railway project in
this state or receives a notice of intent to prepare an
environmental impact statement for an electric railway project in
this state, the department shall provide notification of the
application or notice to each state senator, state representative,
and county judge who represents a district or county, as
applicable, that could be directly affected by the project.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2015.
