The bill would amend Transportation Code to elevate the punishment for operating a commercial motor vehicle without a commercial driver's license from a Class C misdemeanor to a misdemeanor punishable by a fine not to exceed $1,000, or a Class B misdemeanor in the event that the offender had been convicted of the same offense within the previous year. A Class C misdemeanor is punishable by a fine of not more than $500. In addition to the fine, punishment can include up to 180 days of deferred disposition. A Class B misdemeanor is punishable by a fine of not more than $2,000, confinement in jail for a term not to exceed 180 days, or both. Local Government Impact Costs associated with enforcement and prosecution could likely be absorbed within existing resources.
