The bill would amend the Code of Criminal Procedure to limit a convicted person filing a motion for forensic DNA testing of evidence to testing of evidence that has a reasonable likelihood of containing biological material for purposes of challenging a conviction and creates additional limitations on when a convicting court may order forensic DNA testing to instances where the court finds that there is a reasonable likelihood that the evidence contains biological material suitable for DNS testing. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
