                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            April 6, 2015      TO: Honorable Geanie Morrison, Chair, House Committee on Environmental Regulation      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB2470 by Rodriguez, Eddie (Relating to liability insurance for ammonium nitrate operations; creating a criminal offense.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Agriculture Code relating to liability insurance for ammonium nitrate operations; creating a criminal offense.Based on information provided by the Texas Department of Insurance, Comptroller of Public Accounts, and State Health Services, it is assumed that all duties and responsibilities necessary to implement the provisions of the bill could be accomplished within existing resources.The bill takes effect September 1, 2015; however, any changes in law made by the bill apply only to a person who produces, stores, transfers, chemically blends, offers for sale, or sells ammonium nitrate or ammonium nitrate material on or after March 1, 2016. Local Government Impact A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both. Costs associated with enforcement, prosecution, and confinement could likely be absorbed with existing resources. Revenue from fines imposed and collected is not anticipated to have a significant fiscal impact.
