                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION            April 6, 2015      TO: Honorable Carol Alvarado, Chair, House Committee on Urban Affairs      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB2595 by Keffer (Relating to the use of municipal initiative and referendum to restrict property rights.), As Introduced    No fiscal implication to the State is anticipated.  The bill would amend the Local Government Code to prohibit a municipality from holding an election proposed by a petition or approving a petition requesting the repeal or enactment of an ordinance if the repeal or enactment would restrict the right of a person to use or access the person's private property for economic gain. A person whose rights are affected by this violation may sue for injunctive relief to enforce this section.
